Terms & Conditions

Please read these terms and conditions carefully before using our services or website. By engaging our services, you agree to be bound by these terms.

1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you and A&A Home Renovations ("Company," "we," "us," or "our") concerning your access to and use of our website and renovation services. By accessing our website or engaging our services, you accept and agree to be bound by these Terms. If you do not agree with these Terms, you must not use our website or services.

2. Our Services

A&A Home Renovations provides residential and commercial renovation services including, but not limited to:

  • Kitchen and bathroom renovations
  • Basement finishing and remodeling
  • Interior and exterior painting
  • Flooring installation
  • Drywall installation and repair
  • Demolition services
  • Home additions and whole-home renovations

All services are subject to availability and our acceptance of your project. We reserve the right to decline any project at our sole discretion.

3. Estimates and Quotes

We provide free estimates and quotes for our services. Please note:

  • Estimates are approximate and subject to change based on actual conditions discovered during work
  • Final quotes are valid for 30 days from the date of issue
  • Quotes become binding only when both parties sign a formal contract
  • Any changes to the scope of work may result in additional charges
  • Hidden conditions (structural issues, code violations, etc.) discovered during work may require additional work and costs

4. Contracts and Payment Terms

Contract Agreement

All renovation projects require a signed contract outlining the scope of work, materials, timeline, and costs. The contract becomes effective upon signature by both parties and receipt of the initial deposit.

Payment Schedule

Unless otherwise specified in your contract, our standard payment schedule is:

  • Initial deposit (typically 30-50%) due upon contract signing to secure scheduling and order materials
  • Progress payments at specified project milestones
  • Final payment due upon project completion and client approval

Late Payments

Late payments may result in work stoppage and interest charges of 1.5% per month (18% annually) on overdue balances. We reserve the right to place a lien on the property for unpaid amounts as permitted by law.

5. Client Responsibilities

As the client, you agree to:

  • Provide accurate information about your property and any relevant permits or restrictions
  • Obtain necessary permissions from property owners, landlords, or HOAs before work begins
  • Ensure clear access to work areas and adequate parking for our vehicles
  • Remove or protect valuable items, furniture, and personal belongings from work areas
  • Keep children and pets away from work areas for safety
  • Make timely decisions on materials, colors, and design elements to avoid project delays
  • Maintain utilities (water, electricity, heat) throughout the project duration
  • Inform us immediately of any concerns or issues during the project

6. Changes and Modifications

Any changes to the original scope of work must be requested in writing and approved by both parties through a change order. Change orders will specify additional costs and timeline adjustments. We are not obligated to perform additional work without a signed change order and may charge for changes requested after work has begun.

7. Permits and Code Compliance

We will obtain necessary building permits as specified in your contract. Permit costs are included in your quote unless otherwise noted. All work will be performed in compliance with applicable building codes and regulations. We coordinate required inspections with local authorities. Any work requiring specialized licensing (electrical, plumbing, HVAC) will be performed by appropriately licensed professionals.

8. Warranties and Guarantees

Labor Warranty

We provide a 2-year warranty on our labor and workmanship from the date of project completion. This warranty covers defects in installation and workmanship under normal use conditions.

Materials Warranty

Materials and products are covered by their respective manufacturer warranties. We will assist you with warranty claims but are not responsible for manufacturer defects.

Warranty Limitations

Warranties do not cover:

  • Damage caused by improper use, negligence, or lack of maintenance
  • Normal wear and tear
  • Damage from accidents, natural disasters, or acts of God
  • Modifications or repairs performed by others
  • Client-supplied materials or products

9. Liability and Insurance

We maintain comprehensive general liability insurance and workers' compensation coverage. We are not liable for damage to concealed utilities, pre-existing structural defects, or issues not reasonably discoverable during initial assessment. You are responsible for damage to your property caused by failure to follow our care instructions or recommendations.

10. Cancellation and Termination

Client Cancellation

You may cancel the contract under the following conditions:

  • Cancellation before work begins: Forfeit of deposit or payment for materials already ordered
  • Cancellation after work begins: Payment for all work completed, materials purchased, and a cancellation fee (typically 20% of remaining balance)
  • All cancellations must be submitted in writing

Company Termination

We reserve the right to terminate the contract if: payment terms are not met, access to the property is denied, unsafe conditions exist, or if the client breaches any terms of the agreement.

11. Delays and Force Majeure

We strive to complete projects on schedule but are not liable for delays caused by: weather conditions, material supply issues, permit delays, client-requested changes, concealed conditions requiring additional work, or events beyond our reasonable control (natural disasters, labor strikes, etc.).

12. Dispute Resolution

In the event of a dispute, both parties agree to first attempt resolution through good-faith negotiation. If negotiation fails, disputes will be resolved through binding arbitration in accordance with Ontario law. The prevailing party may be entitled to recover reasonable attorney fees and costs.

13. Intellectual Property

We retain ownership of all designs, drawings, plans, and documentation created for your project until final payment is received. We reserve the right to photograph completed projects for marketing purposes unless you request otherwise in writing. You retain ownership of your property and final completed work.

14. Website Use and Content

Our website is provided for informational purposes. You agree not to:

  • Use the website for any unlawful purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with the proper functioning of the website
  • Copy, reproduce, or distribute our content without permission
  • Use automated systems to access or scrape the website

We reserve the right to modify or discontinue the website at any time without notice.

15. Limitation of Liability

To the maximum extent permitted by law, A&A Home Renovations shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our services or website. Our total liability shall not exceed the amount paid by you for the specific services in question.

16. Indemnification

You agree to indemnify and hold harmless A&A Home Renovations, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including attorney fees) arising from: your breach of these Terms, your violation of any law or rights of a third party, or any dispute between you and a third party.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Toronto, Ontario.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

19. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of our services after changes constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.
